Young boy faces life-long disabilities

The story began when the boy was born in late 2009 with a “non-life threatening, easily correctable” condition in which his esophagus was not properly connected to his stomach. A day after his birth, the first of 25 surgeries took place. The medical malpractice attorneys hired by the boy's parents said in a lawsuit that the operations included “experimental procedures” that left the child with permanent brain damage.

West Virginia parents who have had a child suffer an injury due to doctor negligence will be relieved to learn that the lawsuit was recently settled for $30 million. The amount enables the family to provide the care the boy needs today and will need for the rest of his life.

According to the medical malpractice claim filed in Chicago, the boy suffered “profound, irreversible brain injury and cerebral palsy” in the last of his more than two dozen surgeries. That was when his pulmonary artery was severed because of an "inappropriate, off-label use" of a suturing device.

The lawyers alleged in the claim that the surgeon was “medically careless and personally irresponsible” and that the hospital where the operations took place failed to exercise proper oversight.

Of course, if you could ask the parents or the boy himself, they would undoubtedly trade the settlement for a return of the young child's health and capabilities.
