A family gets justice

A family far from us in Huntington feels a great sense of relief after a jury found in their favor in a medical malpractice lawsuit. The family's attorney said, "It was important to them that 12 people who have no stake in the case hear the testimony and came to find what we felt all along" about the death of their loved one in an Alabama hospital.

The woman received an overdose of opiates while she was at the hospital in Etowah County, despite the fact that when she initially admitted to the facility it was with "clear warnings" that she was allergic to opiates. The jury awarded the family $20 million, though as the attorney noted, there is no dollar amount that can compensate for the loss of a loved one.

The woman received the unprescribed overdose of opiates on July 5 of 2011, suffering brain damage that resulted in her death three months later.

The hospital's representatives had argued to the jury that there was no evidence that the woman was given opiates. Yet on the day of the overdose, she was found unresponsive at the hospital at 4:40 in the morning. Urinalysis indicated opiates in her system, as did a second screening. She was also given two tests for opiates while she was in the emergency room; both were positive.

She was given Narcan, a drug used to counteract opiate overdoses, and responded favorably. However, because she had suffered hypoxic encephalopathy – a condition when the brain does not get enough oxygen – she sustained cognitive and neurological damage that ultimately killed her, the lawsuit stated.

We hope the family gets some peace, knowing that a jury has listened to their attorney's arguments and agreed. It's not an easy process for anyone to go through, but with the help of a dedicated attorney experienced in medical malpractice litigation, the results can be justice.
