A one-time slip or fall can cause a lifelong injury

A slip or trip and fall can happen at any time. We venture that nearly everyone in West Virginia has a personal story about how they once took an unexpected tumble. Maybe it resulted in a bruise or a sprained ankle. If it was more serious, you might have suffered a broken bone or traumatic brain injury. The worst-case scenario might be one in which an elderly loved one falls and breaks a hip. At least one study indicates a hip break increases the risk of early death in older women.

Even when a slip and fall does happen, it can be easy to dismiss it as an unfortunate accident. Victims mostly just want to get better and not raise a fuss. Besides, insurance covers it, right? Outdoors, a buckled sidewalk or icy conditions might be problems. Indoors, torn carpet or wet floors could result in falls. Accidents can't be the result of random bad luck. And, if a victim bears some fault for the fall, West Virginia law makes it possible to reduce the amount of compensation awarded.
