Family settles for $15 million in heartbreaking birth injury case

Regular readers of our Huntington Legal Issues Blog know that we believe few things in life are more heart-breaking than birth injuries. When a birth injury is caused by doctor negligence, the pain for the family is even more acute.

A suburban Chicago hospital recently agreed to a $15 million settlement of a medical malpractice lawsuit with the family of a 6-year-old girl who suffered severe, lifelong brain damage during delivery.

The family's lawsuit says the little girl suffered brain damage during her January 2011 delivery. She now has cerebral palsy.

The family contends that hospital staff erred when they did not stop using labor-inducing Pitocin. They claimed in their lawsuit that because of the staff's "overdosing" of the mother during labor, she began having too-strong contractions that were too close together.

The contractions "stopped oxygen delivery and blood flow to (the baby's) brain," the family's medical malpractice attorney said in a statement.

The bottom line for the girl is that she cannot walk or talk or care for herself and "will require extensive future medical care and therapies," according to the lawyer's statement.

A Chicago Tribune article on the case said the settlement money is going into a local bank that has been designated as guardian of the payment. The money will then be managed in coming years by finance professionals and will be used only for the benefit of the child.
