West Virginia woman prevails in medical malpractice case

A West Virginia woman has an incredibly difficult, painful medical history. And her experiences with a surgeon who was supposed to help her is a big part of what has made life so arduous. Back in the early 1990s, she had a medical condition which resulted in a double mastectomy and reconstructive surgery.

Four years ago, the Daniels woman went to a plastic surgeon for a breast reconstructive operation. But the surgery caused deformities, she said in a lawsuit, as well as asymmetry and other issues. Afterwards, the surgeon told her she would need "additional corrective surgery." So three years ago, she returned for a second operation. According to her legal complaint, the two operations have required her to have to undergo even more surgeries, and to have to endure injuries, disfigurement, pain, mental anguish and lost wages.


She later filed a medical malpractice lawsuit against the Maryland doctor who performed the two critical breast reconstruction surgeries. The jury that heard her case found him negligent, saying he deviated from the standard of care.

She is to receive $64,000 from him for her medical expenses, a news article states, as well as $500,000 for noneconomic damages.

Of course the amount will not make up for the physical and emotional toll taken. Hopefully, it will help serve as a caution to doctors who might be more interested in their profits than their patients.
