Injured for life

Some injuries caused by a negligent doctor or medical facility might result in months or even years of physical pain, mental anguish, repeated surgeries and physical therapy. Other injuries are even worse.

A birth injury caused by a negligent physician or hospital can mean a lifetime of diminished abilities for which there is no cure and no healing process. A West Virginia mother and child charge that the staff of a medical center in the northeastern part of the state was negligent when they failed to hospitalize them nearly three years ago.

The alleged failure resulted in an injury that will last a lifetime for a child born in June of 2013. The child now nearly three years old has serious cerebral palsy and other injuries, according to a medical malpractice suit filed on behalf of the mother and child. The suit names the Berkeley Medical Center of Martinsburg as defendant, the West Virginia Record reports.

The mother went to the facility in late May of 2013 with vaginal bleeding. She was seen by a nurse and certified nurse midwife, briefly admitted and then discharged. Three days later, she was back at the facility with continued bleeding and pain.

She was again discharged.

The next day, she was back at the facility, still suffering bleeding. She was discharged that day, though hospital staff determined that her case would be reviewed a meeting to review high-risk cases. The meeting was scheduled for the following week.

A couple of days later, staff at Winchester Medical Center delivered the child via C-section.

The mother's lawsuit says defendants failed to hospitalize her and her unborn child, failed to make sure she'd been seen by a doctor despite her high-risk condition, and failed to provide the level of care needed.

For those parents who believe their child has suffered a birth injury due to negligence by hospital staff, a doctor or nurse, a conversation with a Huntington attorney experienced in medical malpractice can make options clear. That conversation is how the pursuit of justice and compensation begins.
