Unneeded, unwanted

Regular West Virginia readers of our blog might recall the story of a small-town cardiologist written up last year in the New York Times. Unfortunately, he wasn't being hailed for his dedication to patients or a breakthrough in his practice. Instead, Dr. Arvind Gandhi made the pages of the Times because he's being sued for medical malpractice by nearly 300 people.

He's accused of implanting in the people of Munster, Indiana, unneeded pacemakers and unnecessary defibrillators and for routinely scheduling invasive procedures for which there was no medical justification.

Unsurprisingly, it's reported that he and other practitioners at Cardiology Associates of Northwest Indiana reaped a financial windfall from these implants and procedures. Also unsurprising are the denials the defendants have issued.

The first of the hundreds of cases has gone to trial, however, and the verdict was returned in early December. The jury found for the plaintiff, awarding her $450,000.

Some observers expect similar outcomes in coming days as people claiming medical malpractice take their allegations before judges and juries. Apparently many of those making accusations say they were regularly subjected to invasive procedures such as angiograms. One former Gandhi patient had 21 of the tests administered. Others had angiograms scheduled every six months.

An attorney representing some plaintiffs said reviews of medical records say doctors at the clinic regularly performed unnecessary procedures and implanted in patients devices that were not needed.

Those who have had unneeded procedures performed on them can speak with Huntington attorneys experienced in complex matters of medical malpractice in order to learn more about available legal options and compensation.
